With a view to give opportunity to the applicant/petitioner to contest the suit, by order dated 03.09.2024, the petition filed by the applicant/petitioner was allowed, the order passed by the trial Court rejecting the application filed by the applicant/petitioner to recall the order of suit to proceed without written statement of the applicant/petitioner, was set aside. This Court directed the petitioner to file written statement within four weeks.

The learned counsel for the applicant/petitioner submits that the petitioner is having it’s registered office at Pune and thus written statement was sent by courier. It is submitted that due to delay in delivery of courier, the written statement could not be filed within a period as directed by this Court. It is submitted that time be extended to file the written statement.

It is not the case of the applicant/petitioner that time of four weeks was not sufficient to file the written statement. In that view of the matter, I am not inclined to entertain the present application.
