1. Contempt Petition alleges contempt of the judgment

dated 5^th August 2015 passed by the Family Court, Thane. It is

contended that respondent has committed contempt of clause 3

¶19

and 4 of the judgment dated 5^th August 2015 as regards the

payment of maintenance and handing over custody of the child.

Learned counsel appearing for the parties submit that subsequently the parties have amicably settled the dispute and have executed the Consent Terms. The terms of settlement are handed over. Same is taken on record and marked “X” for identification. It is submitted that in view of the Consent Terms entered into between the parties the contempt is purged and as such petitioner does not desire to prosecute the Contempt Petition.

Considering that the dispute has been amicably settled between the parties and the contention is that contempt has been purged, continuation of contempt proceedings would be an exercise in futility. As the contempt is already purged as recorded in the Consent Terms executed by the parties voluntarily, the Contempt Petition stands disposed of.

Contempt Notice issued on 3^rd April 2017 stands discharged. The red corner notice issued against respondent No.1 and the yellow corner notice issued against the minor child are hereby quashed and set aside.

In view of the disposal of the contempt petition nothing survives for consideration in the Civil Application, Civil Application is disposed of.
