Ashok Narayan Patil Vs the Special Land Acq. Officer and Ors.

Ms. S.A. Kale, learned counsel appearing for the claimants has filed on record judgment of this Court passed in First Appeal No. 706/2007 dated 28.02.2024 and other connected matters (including First Appeal Nos. 715, 717, 713, 714,718, 716, 815 of 2007) wherein this Court has allowed the references filed by the claimants against the order of Reference Court passed in LAR No. 80/2006 and 79/2006 and other matters.

The learned AGP for the State submits that present First Appeal No. 1560/2007 filed by the State corresponds to the LAR No. 80/2006 and First Appeal No. 1558/2007 filed by the State corresponds to the LAR No. 79/2006. The learned AGP submits that in view of the order passed by this Court in First Appeal No. 706/2007 and other connected matters, enhancement of compensation was granted to the claimants in above appeals and nothing remains in the present first appeals filed by the State.

In view of the above, the appeals filed by the State are dismissed. In view of the dismissal of the first appeals, the claimants being entitled to the amount deposited, the bank guarantee given given by the claimants to the State shall stand cancelled. All pending civil applications are disposed of.
