Heard the learned counsel for the applicant,

learned APP for the respondent-State and learned counsel for respondent No.2.

The applicant seeks bail in Crime No.194 of 2023, registered with Karmad Police Station, District Aurangabad, for the offences punishable under Sections 363, 376(2)(N), 506 of the IPC and Section 4 and 6 of the POCSO Act.

The applicant seeks bail on the ground of health. He has produced the documents from the Jail Authority. He has been diagnosed submental lymphadenopathy. In simple words it is a signal of cancer. The medical papers support the contention of

the applicant that he is suffering from a serious disease that may require regular medical attendance. Earlier he was treated at private hospital. That time also he was advised for biopsy. The medical papers collected from the jail authority support the contention of the applicant that he needs the consistent treatment and assistance of his family.

The strong objection has been raised by the learned counsel for the victim. However, the life of the victim cannot be put in danger only for want of the proper treatment and care.

In view of the above, the following order is passed :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant MAHENDRA TRYAMBAK SATHE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant should not tamper with the prosecution witnesses.
