Heard the learned Advocate for the

applicant/appellant and learned APP for the State.

It is stated that for 15 days the sentence be suspended and the applicant be released on bail. It is stated that father of the applicant has expired on 26.08.2024. It is stated that applicant/accused is the son of the deceased. He is required to perform the rituals. He has been in jail. It is submitted that considering the peculiar facts and circumstances he may be granted bail by suspending the sentence for 15 days.

Learned APP submitted that the incharge of the Channi Police station, Taluka Patur, District Akola has informed her that the father of the applicant/appellant has died on 26.08.2024.

In my view, considering this factual position, it is just and proper to allow this application.

Accordingly, the criminal application is allowed.

The sentence awarded in terms of the order dated 21.10.2023 by the learned Additional Sessions Judge, Akola, in Sessions Trial No. 98 of 2020 shall remain suspended till 12.09.2024.

The applicant/appellant be released on bail on his furnishing PR bond in the sum of Rs.15,000/- and surety in the like amount.

The appellant/applicant shall visit the Channi Police station, Tal. Patur, District Akola after every alternate day during this period at 5:00 p.m..

The appellant/applicant shall surrender by the evening of 13.09.2024.

¶23

The appellant/applicant shall not misuse the liberty granted pursuant to this order in any manner.

The application stand disposed of.
