1 The Petitioners assails order dated 3 October 2019 passed by the Additional Judge, Bombay City Civil Court on Application below Exhibit 36 marking four documents as Exhibits. It is the case of the Petitioners that the documents have been marked without examination of witnesses.
2 The learned Counsel for the Respondents makes a statement that the Petitioners/Defendants do not wish to rely upon four documents at Exhibit Nos.38, 39, 40 and 41 collectively. In view of the said statement being made by the learned Counsel for the Respondents, nothing remains to be determined in the present Petition. Recording the statement made by the learned Counsel for the Respondents, the Writ Petition is disposed of.
