The learned counsel for respondent No.2 submitted that this petition is covered by the judgment and order of the Apex Court dated 26 July 2023 in Civil Appeal No.8834/2011. He further submitted that in compliance with the Supreme Court’s directions, the

respondent Corporation has already refunded the penalty amount to the petitioner – Axis Bank.

In view of this, the complaint and the impugned order dated 1 April 2010 in SCC No.70/2010 pending on the file of the learned JMFC, Pune are hereby quashed.
