the Tribunal about negligence of deceased as admittedly, the said truck was stationed on the middle of the road. It has come on record that the truck was stationed near the dividing line of the road and there was kachha road on the left side of the road but Respondent No.2 did not station his truck on kachha road. He stopped his truck near the dividing line, if other vehicle was to go ahead, then that vehicle had to overtake the stationary truck of Respondent No.2. The other side of the dividing line was for the vehicle which are coming from opposite direction. It is contention of learned counsel for the Respondent Nos.1 and 2 that truck was stationed on left side of the road. I do not agree with this contention, as record shows said truck was stationed on road near dividing line. There was kacha road adjacent to main road, but said truck was not stationed on kacha road. It is contention of learned counsel for Respondent Nos.1 and 2 that said truck had stopped behind other trucks which were already stopped. In my view, though other trucks were stopped on road, it does not mean that Respondent No.2 can stop his vehicle negligently on middle of road, when there was kacha road adjacent to main road. It proves that said truck was negligently stationed on middle of the road.
