These matters were listed on board for two times already 5 weeks time has been granted, but till date learned Advocate for Appellant has not taken any steps against deceased Respondent Nos. 1, 4, 6 & 8 in First Appeal No. 1102 of 1991 and against deceased Sole Respondent in First Appeal No. 1105 of 1991. The learned Advocate Mr. Rajesh Parab on behalf of legal Heirs of Sole Respondent in First Appeal No. 1105 of 1991 submitted that Sole Respondent i.e. Mr. Motiram Tukaram Shinde is expired on 30.10.2016 and he intimated this thing to the Registry and

Government Pleader on 03.08.2022 by letter and also attached copy of death certificate of Sole Respondent. Hence, learned Advocate for Appellant is directed to take steps against deceased Respondent Nos. 1, 4, 6 & 8 in First Appeal No. 1102 of 1991 and against deceased Sole Respondent in First Appeal No. 1105 of 1991 within 02 weeks, failing which First Appeal No. 1102 of 1991 would stand abated against deceased Respondent Nos. 1, 4, 6 & 8 and First Appeal No. 1105 of 1991 would stand abated against deceased Sole Respondent without further reference to the Court of Registrar (Judicial-II).
