When this application is called out for hearing, which prays for appointment of arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996, the learned counsel appearing for the applicant submits that an arbitration clause in the present case is contained in a registered leave and license agreement. He concedes that as per settled law such disputes are not arbitrable, despite an arbitration clause forming part of such an agreement. 2. In view of the above, the learned counsel appearing for the applicant seeks permission to withdraw the present application, with liberty to pursue such remedies as may be available in law. Hence, the application is disposed of, as withdrawn, with liberty as aforesaid.
