This appeal is directed against Judgment and order
dated 29.6.2005, passed by the learned Judicial Magistrate,
First Class, Shrivardhan, Raigad, in SC No.327 of 2002,
whereby the accused/respondent, came to be acquitted of the
offence punishable u/s 138 of the Negotiable Instruments Act,
1881.
2.Learned Counsel for the appellant and respondent,
jointly submitted that the appellant and respondent/original
accused have expired, and accordingly, nothing survives in
this appeal. In view of this, the appeal stands disposed of.
