Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R.No.43 of

2022 registered with Junnar Police Station for the offences punishable under Sections 328, 188, 272, 273 of the Indian Penal Code and Section 26(2), 26(4), 30(2)(a) of the Foods Safety and Standards Act, 2006.

On 4 February 2023 in a raid conducted at a shed in front of the house of Mr. Vidhate at Village Shiroli, contraband articles (gutkha – panmasala) were found to have been stored. The said contraband articles were allegedly stored by the Applicant.

By an order dated 3 April 2023, this Court had granted interim protection. Evidently, the contraband articles have been seized and samples have been collected. The question as to whether in a case of the present nature, the provisions of Section 328 of the IPC can be invoked, awaits decision of the Supreme SSP 1/2

In the aforesaid backdrop, at this stage, further custodial interrogation of

the applicant does not seem to be warranted.

Hence, the following order :

ORDER

(i) In the event of the arrest of the Applicant – Mayur Savkar Vidhate in connection with C.R.No.43 of 2022 registered with Junnar Police Station, the Applicant be released on bail on furnishing a PR bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(ii) The Applicant shall not tamper with the prosecution evidence

and/or give threat or inducement to any of the prosecution witnesses and the persons acquainted with the facts of the case.

(iii) The Applicant shall not indulge in identical activities for which he

has been arraigned in the instant case.

(iv) The Application stands disposed.
