Heard the learned Counsel for the applicants and the learned APP for the State.

ABA No.631 of 2023 was listed before the Court on 1^st March, 2023. This Court was persuaded to grant interim bail after ascribing reasons.

ABA No. 721 of 2023 was listed before this Court on 10^th March, 2023 and noting that the co-accused Amarjeet Bhosale has been granted interim bail by aforesaid order dated 1^st March, 2023, interim bail was granted to the applicant – Phillip as well. 4) The learned APP, on instructions, submits that the applicants have appeared before the Investigating Officer pursuant to the aforesaid orders and co-operated with the investigation.

Having regard to the nature of the accusation, the fact that this Court had granted interim protection after ascribing reasons and the applicants have been on interim protection for more than seven months, at this length of time, further

custodial interrogation of the applicants does not seem warranted.

Mr. Avchat, the learned Counsel for the first informant – Intervenor in IA No.2162 of 2023 and IA No. 2161 of 2023 informs the Court that subsequent to the order of interim protection, another crime has been registered against the applicant on 1^st June, 2023 vide CR NO. 437 of 2023, at Satara City police station.

The learned Counsel for the applicant submits that the genesis of the said allegations is in a dispute over the management of the Trust. The applicant was allegedly a member of the unlawful assembly in the prosecution of the common object of which certain offences were committed.

In the aforesaid backdrop, I am impelled to make the

orders of interim bail absolute subject to certain conditions.

Hence, the following order.

ORDER

I) The orders of interim bail dated 1^st March, 2023 and 10^th March, 2023 are made absolute on the terms and conditions incorporated therein.

II) In addition, the applicants shall attend the police station on every alternate Saturday in between 10.00 am to 12.00 noon for a period of six months.

III) Since condition of attendance at the police station on every alternate Saturday, for a period of six months, is imposed, the condition not to leave the limits of Satara, stands relaxed.

IV) The applicants shall not contact the first informant, any of the witnesses or any of the persons acquainted with the facts of the case.

¶44

V) The applicants shall furnish their addresses and contact details to the Investigating Officer and intimate change, if any.

¶45

VI) The applicants shall regularly attend the proceedings before the jurisdictional Court.

¶46

VII) The applications stand disposed.

¶47

VIII) In view of the disposal of the applications, the Interim Applications also stand disposed.
