1. Heard learned counsel for the applicant and learned APP for the State.

2. This is an application for pre-arrest bail in respect of the offence punishable under Sections 326, 452, 384, 427, 504, 506 read with 34 of the Indian Penal Code, 1860 in connection with C.R. No.598 of 2020 dated 17/10/2020 registered with Aarey Police Station.

3. The applicant is accused No.2. The date of the incident is 16/10/2020. The accused No.1 who is the main accused

has been granted regular bail. It is the case of the prosecution that the applicant and the accused No.1 entered in the informant’s shop and demanded cigarette. As they were informed that the cigarette is not available the applicant and the accused No.1 abused the informant in a filthy language. The applicant also threw the other articles like bottles, eggs etc in the shop. It is further alleged that the applicant and the co-accused picked up stones and assaulted the informant. The accused No.1 has been granted regular bail. The charge-sheet has been filed against the main accused. The applicant is 23 years of age. The complainant suffered simple injuries. Present is not a case where the custodial interrogation of the applicant is warranted. There are no criminal antecedents reported against the applicant. Hence, the following order :-

(a) In the event of arrest of the applicant in connection with C.R. No.598 of 2020 registered with Aarey Police Station, the applicant–Siddesh Ganesh Chanori be released on bail on his furnishing P.R. Bond

in the sum of Rs.25,000/- with one or more sureties in the like amount;

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence;

(c) The applicant shall attend the concerned police station on 11/01/2023, 12/01/2023 and 13/01/2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when required by the Investigating Officer. In any case, the applicant to report the concerned police station once in a month on every Monday, between 11.00 a.m. and 1.00 p.m.;

(d) The applicant shall furnish the details of his residential address and phone number to the investigating officer.

4. The Anticipatory Bail Application is disposed of.
