It is seen from the memo of petition and as argued by learned counsel for the petitioner that the basic point raised in the

petition was not that of purchase policy or cotton procurement policy of the State and Central Governments but it was of shoddy implementation of the procurement of cotton by the State Government as well as Central Government. It is the contention of the petitioner that the cotton procurement centres are deliberately opened by the State and Central Government belatedly, so that the private purchasers get the advantage and are able to purchase the cotton from framers at throwaway prices which cotton so purchased by the private persons, is then sold at much higher rates at the cotton procurement centres opened belatedly by the State Government and Central Government. The learned counsel for the petitioner submits that this way the exploitation of farmers is going on and this is happening in a state which is governed by the principle of welfare of its citizens as per the directive principles of the State policy.

All these aspects of the matter, however, have not been considered by this Court when it disposed of the PIL filed by the petitioner, vide its order dated 9^th March 2022. There is thus an apparent error on the face of the record and, therefore, the order dated 9^th March 2022 deserves to be recalled.

The Misc.Civil Application is allowed. The order dated 9^th March 2022 is hereby recalled. PIL No. 12/2022 is directed to be restored to the file of this Court forthwith and, thereafter,

notices be issued to the Respondents.

Mrs. Ketaki Joshi, learned GP and Mr. N.S. Deshpande, learned ASGI waive notices for respective Respondents. The copy of the amended petition be furnished to each of the Respondents.
