1.Heard Mr. Chhabra, learned counsel appearing for the
Petitioners and Mr. Digvijay Patil, learned counsel appearing for the
Respondent No.10.

2.The Petitioners are original Plaintiffs. By the impugned order
dated 14th December, 2018, the learned Trial Court has held that
Plaintiffs have valued the suit as per Section 6 (iv) (j) of the Bombay
Court Fees Act instead of Section 6 (iv) (d) of the Bombay Court
Fees Act and further directed to correct the valuation. Accordingly,
the Plaintiff has filed application bearing Exhibit-64 in Special Civil

Suit No. 1474 of 2018 under order VI Rule 17 of CPC seeking
amendment. The said amendment application was allowed by order
dated 13th January, 2020 passed by learned 16th Joint Civil Judge,
Senior Division, Pune. Accordingly the plaint was amended by
inserting paragraph number on page 2 of the plaint and by
amending paragraph 49 of the plaint. The said amendment is set out
hereinbelow for ready reference:-

3.Mr. Chhabra, learned counsel appearing for the Petitioners
states that in view of the said subsequent development of amending
the plaint, the petition has become infructuous. However, he states

that liberty be given to challenge the impugned order dated 14th
December, 2018 in Appeal, if the occasion arises.

4.The Writ Petition is disposed of as infructuous subject to the
liberty as prayed.
