It is alleged that Senior Police Inspector of the Andheri Police
Station has proposed Chapter Proceedings bearing No.03/2020 under Section
110 (e)(g) of the Criminal Procedure Code against the Petitioner and
accordingly order dated 22nd January 2020 came to be passed by the Special
Executive Magistrate, Andheri Division. Thereafter a show cause notice dated
18th August 2020 came to be issued to the Petitioner and his associates by the
Externing Authority i.e. Deputy Commissioner of Police, Zone-10, Mumbai. The
said show cause notice referred to the offences registered against the Petitioner
and his associates. It is alleged in the said show cause notice that the
Petitioner and his associates are acting as a gang and forcibly collecting money
at the gunpoint of deadly weapons from the residents, businessmen, shop
owners and peddlers. It is also alleged in the show cause notice that the
Petitioner is indulging in illegal activities of chain snatching, robbery, extortion
etc. it is also alleged that the Petitioner and his associates creating terror as
also threatening the persons residing in the jurisdiction of Andheri Police
Station. Therefore, the Externing Authority issued the show cause notice to
the Petitioner to show cause as to why the externment proceedings should not
be initiated against him and as to why he should not be externed from Mumbai
