.We have heard Mr. Bhokarikar, learned counsel for the petitioner
and Mr. Navandar, learned counsel for respondent Nos. 1 and 2.
2. Affidavit in reply is filed by the Divisional Personnel Officer, DRM
office in Central Railways. Paragraph No. 6 of the affidavit reads thus :
“6.I say and submit that, now the petitioner’s
guardian Shri. Prakash Digambar Gosavi has submitted all the
required documents to the settlement section of the
respondent and accordingly the settlement case file duly
completed by the respondent has been sent to Sr. DFM Office
for further process i.e. generation of Pension Pay Order and
after generation of Pension Pay order the pension will be

disbursed and pay to the petitioner through the concern Bank.
The copy of settlement section letter dated 11/05/2021 vide
which the settlement case file of the petitioner has been sent to
Sr. DFM Office is annexed as ANNEXURE-‘R-4’.”
3.It would appear that, the respondent does not dispute the
entitlement of the petitioner for the family pension. The only process of
generation of pension pay order has remained. It is submitted that after
generation of the pension pay order the pension will be disbursed and
paid to the petitioner through the concern bank.
4.In the light of the said statement, we expect that the process
would be completed within a period of three (03) months and
accordingly family pension would be paid to the petitioner.
5. Writ petition is disposed of. No costs.
