354-A, of the Indian Penal Code (for short “IPC”) and under Sections 3 (1) (u), 3 (1) (w), 3 (2) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, the appellant has preferred this appeal.

Brief facts of the case in the present appeal can be summarized as under :

The appellant is the husband of Dipali Kale, who is Sarpanch of Grampanchyat Tandulwadi, Taluka Kallam, District Osmanabad. The informant was appointed as Gramseveka in the Grampanchyat Office, Tandulwadi, Tq. Kallam, in the month of August, 2019. Subsequently, she was transferred to other places at the request of Sarpanch and others.

The informant alleged that since prior to her joining as Gramsevak, the appellant and his wife gave an application for her transfer, but the said application was not considered by the higher authority. It is contended that the informant belonged to the Scheduled caste. The appellant used to visit the Grampanchyat Office and used to demand money of the work carried out by him. It is alleged that the appellant was not providing proper bills along with GST, therefore, his bills were not considered by the informant. It is alleged that the appellant used to score out the minutes recorded in the monthly meeting of Book. The informant had taken objection to

the acts of the appellant and informed his acts to her higher authorities.

It is alleged that on 06.04.2021 at about 2.00 p.m. the appellant took away the inverter and two batteries installed in the Grampanchyat Office and installed it in his house. Due to the removal of inverter and batteries, the work of the Grampanchyat Office was affected. The informant reported the said incident to the B.D.O. On 06.06.2021 at about 4.00 p.m. the informant and other employees were present in the office. The appellant entered into the office under the influence of liquor. He asked the other employees to leave the office. The appellant sat in front of the informant and started teasing her by making gestures. Due to said act, she went out of the office for about one and half hours. The appellant without any work sat in the office for long time and obstructed the informant from discharging her public duties. It is also alleged that since October, 2019, till 06.06.2021, the appellant caused ill-treatment and harassment to the informant on the ground that she belonged to the scheduled caste, therefore she lodged F.I.R.

On the basis of the above allegations, the learned counsel for the appellant submits that the informant was incompetent, therefore, the Sarpanch and other members of the Grampanchyat

used to make grievances against her. On the basis of complaintapplication given by the Grampanchyat members, the informant was transferred to some other Grampanchyat. It is contended that the appellant never obstructed or harassed the informant from discharging her duties, but he had given complaint against the informant to her higher authority, therefore, she has a grudge against him. So she has filed a complaint. The learned counsel for the appellant invited my attention to the letters written by the Grampanchyat to Block Development Officer, regarding the conduct and behaviour of the victim. The Deputy C.E.O. of Zilla Parishad, Osmanabad had called report from B.D.O. It appears that inquiry was held by the Block Development Officer and ultimately the informant was transferred to some other Grampanchyat and in her place Mr. Shirsagar was appointed as Gramsevak.

Admittedly the informant was appointed as Gramsevak in the month of August, 2019, but before she took the charge of duty as Gramsevak, the Sarpanch and the members of the Grampanchyat had given an application dated 25.07.2019, wherein, it was requested that the informant should not be appointed as Gramsevak. So it can be said that even prior to the joining of informant, the Sarpanch and other members of the Grampanchyat were having a grudge against her. In the FIR of the informant has given series of events as to how

she was prevented from working as Gramsevak. It appears from the FIR that the appellant had taken lead in the agitation against the informant. It is the specific allegation against the appellant the he used to visit Grampanchyat Office as his wife was Sarpanch. He had removed inverter and batteries from the Grampanchyat Office. The informant stated that the said inverter and batteries were re-installed in the month of October, 2019, and the informant had informed the acts of the appellant to her higher authority for taking action against him. So it can be said that the relations between the appellant and the informant were not cordial.

The informant had categorically alleged that on 06.06.2021 at about 4.00 p.m. the appellant entered in the Grampanchyat Office under the influence of liquor and outraged her modesty. The employees of Grampanchyat have also stated in their statements that the appellant had entered in the Grampanchyat Office under the influence of liquor and he was teasing the informant. Admittedly, the informant was working as Gramsevak and she was performing her duties as public servant. She was obstructed while discharging her official duties. She specifically alleged that she was being harassed by the appellant as she belonged to scheduled caste. The statements of employees of the Grampanchyat are recorded in the present case, wherein, they have supported the incident narrated

by the informant in her FIR. Therefore, prima-facie, it can be said that the appellant was causing harassment to the informant while she was discharging official duties as such public servant. There are specific allegations against the appellant that he outraged modesty of the informant and the said facts are supported by the independent witnesses namely the employees of Grampanchyat, therefore, it can be said that there is sufficient material against the appellant for involving him in the offence under the Atrocities Act.

Learned counsel for the appellant has submitted that there are no allegations against the appellant that he abused the informant over her caste. In fact, the appellant was making grievances about the conduct and behaviour of the informant to her higher authority. To substantiate this point he relied on the ratio laid down in the case of Hitesh Verma v. State of Uttarakhand and another reported in 2021 CRI. L.J. 1 , wherein it is held that

“13.The offence under Section 3(1)(r) of the Act would indicate the ingredient of intentional insult and intimidation with an intent to humiliate a member of a Scheduled Caste or a Scheduled Tribe. All insults or intimidations to a person will not be an offence under the Act unless such insult or intimidation is on account of victim belonging to Scheduled Caste or Scheduled Tribe. The object of the Act is to improve the socioeconomic conditions of the Scheduled Castes and the Scheduled Tribes as they are denied number of civil

rights. Thus, an offence under the Act would be made out when a member of the vulnerable section of the Society is subjected to indignities, humiliations and harassment. The assertion of title over the land by either of the parties is not due to either the indignities, humiliations or harassment. Every citizen has a right to avail their remedies in accordance with law. Therefore, if the appellant or his family members have invoked jurisdiction of the civil court, or that respondent No.2 has invoked the jurisdiction of the civil court, then the parties are availing their remedies in accordance with the procedure established by law. Such action is not for the reason that respondent No.2 is member of Scheduled Caste. ”

In the present case there are no allegations against the appellant that he hurled abuses to the informant over her caste. There are allegations that he outraged the modesty of the informant while she was discharging official duties as Gramsevak. The said allegations are substantiated by independent witnesses namely the employees of the Grampanchyat. The object of the Act is to improve the socio-economic conditions of the scheduled caste as they are denied number of civil rights. Thus, an offence under the Act would be made out when a member of the vulnerable section of the Society is subjected to indignities, humiliations and harassment.

The learned counsel for the appellant further relied on

the ratio laid down in the case of Kedarsingh Dharma Patil & Anr Vs.

The State of Maharashtra & Anr. Reported in 2019 ALL MR (Cri) 2974. , which runs as under :

“3-w (I) – intentionally touches a woman belonging to a Scheduled Caste or a Scheduled Tribe, knowing that she belongs to a Scheduled Caste or a Scheduled Tribe, when such act of touching is of a sexual nature and is without the recipient’s consent;

(ii) uses words, acts or gestures of a sexual nature towards a woman belonging to a Scheduled Caste or a Scheduled Tribe, knowing that she belonging to a Scheduled Caste or a Scheduled Tribe.

Explanation :- For the purposes o sub-clause (i), the expression “consent” means an unequivocal voluntary agreement when the person by words, gestures, or any form of non-verbal communication, communicates willingness to participate in the specific act.”

In the above cited case the accused was facing charge

under Section 3 (1) (r), 3 (2) (va), 3 (1) (g) of the Act and in the case at hand the appellant is facing charge under Section 3 (1) (u), w (ii) of the Atrocities Act.

If the contents of the FIR are read minutely, it can be said that the informant was subjected to indignities, humiliations and harassment at the hands of the appellant, therefore, the ratio laid down in the above cited both the cases is not helpful to the appellant.

On going through the contents of FIR, it can be said that there is prima-facie material against the appellant for the charge under Section 3 (1) (u) and 3 (1) and 3 (w) (ii) of the Atrocities Act. On the basis of material placed on record it can be said that offences under the Atrocities Act are prima-facie are made out against the appellant, therefore, there is bar under Section 18-A of the Atrocities Act to entertain the appeal for the grant of pre-arrest bail to the appellant. The trial Court has rightly considered the material placed before it, therefore, there is no need to interfere with the order passed by the Trial Court. Hence following order :
