fate. The said municipal structures are equally old and dilapidated.
They are not out of the purview of Section 354 of The Mumbai
Municipal Corporation Act, 1888 (“the MMC Act”). As a
precautionary measure, M/s. Sahastrakala Architects & Engineers
inspected the present chawl-like structures and recommended that
the same be demolished and that they be reconstructed to avoid loss
of human life. On this recommendation, on 29th April 2015,
Tanveer Iqbal, occupant of room/tenement No.6, Chawl No.3, Old
Slaughter (Abattoir) House, S.V. Road, Bandra (West), Mumbai-
400 050 was informed in writing that this chawl would have to be
vacated by him, and vacant and peaceful possession would have to
be handed over to the Municipal Corporation. The MCGM assured
him that it did not intend to extinguish or put an end to his right to
occupy a tenement in the structure as a tenant of the Municipal
Corporation. However, as a temporarymeasure and once he handed
over vacant and peaceful possession, Tanveer Iqbal would be
housed temporarily in transit or temporary alternate
accommodation. The same Notice was issued to everybody. That
was followed on 2nd January 2017 by the communication at page
646 of the paper-book. Thereafter, referring to the same report of
the Consultants, and the same recommendations, the MCGM
further stated that after the tenements are vacated, the chawls have
to be demolished. The petitioners would have to be shifted and they
would be accordingly shifted to Mahul, but only and purely as a
temporary measure. They were called upon to produce relevant
documents in relation to their occupancy as well.
