Milind Madhukarao Nandanwar Vs State of Maharashtra through Its Secretary and Ors.

Heard. By this petition, the Petitioner is challenging the order passed by the Scheduled Tribe Certificate Scrutiny Committee, Nagpur. By the said order, the Petitioner's caste certificate is invalidated. Though impugned order is passed by the Committee at Nagpur, the petition is filed before this bench [the Bombay Bench] on the ground that the Petitioner is serving in Mumbai and he is apprehending that his services would be terminated due to invalidation of his caste certificate.

Since the impugned order is passed by the quasi judicial authority which is within the jurisdiction of Nagpur Bench of this Court, the petition ought to have been filed before the Nagpur Bench

of this Court. We are, therefore, not inclined to entertain this petition.

Mr. Mendadkar, learned counsel for the Petitioner faced with the difficulty, seeks leave to withdraw the writ petition with liberty to file fresh one before the Nagpur Bench of this Court. Leave with liberty as prayed for is granted. In order to enable the Petitioner to approach the Nagpur Bench of this Court, we direct for the limited period of four weeks from today, no coercive action shall be taken against the Petitioner based upon the order impugned in this petition.
