Islam Khastaul Khan Vs the State of Maharashtra

This application is preferred for bail and suspension of the impguned judgment and sentence dated 21.3.2016 passed by the learned Metropolitan Magistrate, Vikhroli, Mumbai in C.C. No.1093/PW/2010. The maximum sentence awarded is 6 months SI and fine of Rs.1,000/- under each head. The said order was confirmed in Criminal Appeal No.354 of 2016 vide order dated 16.3.2019 passed by the learned Additional Sessions Judge, Greater Mumbai.

The learned Counsel for the applicant/accused submits that the applicant/accused has a good case on merits. The offences are bailable. Further, the applicant/accused was on bail throughout the trial and also during the appeal.

In view of the submissions of the learned Counsel and also as there is no chance that the Revision Application will be heard in near future, the application is allowed on the following terms:

i) The applicant/accused shall be released on bail upon furnishing a P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;

ii) The applicant/accused shall make himself available on all the Court dates.

Issue notice to the respondents in the Criminal Revision Application, returnable on 24.6.2019.

6. Criminal Application stands disposed of accordingly.
