Learned Counsel for the applicant/accused is facing prosecution under sections 406, 409, 420, 468, 471, 477A and 120 of the Indian Penal Code in C.R. No.130 of 2017 registered with Bundgarden police station, Pune. The learned Counsel submits that the applicant wants to travel to the United Kingdom to attend his daughter's graduation ceremony which is scheduled between 15.7.2019 and 17.7.2019. He points out that earlier he was allowed to travel to USA during 20.2.2019 to 2.3.2019 to attend the engagement ceremony of his brother in law.

Learned Prosecutor is present and opposes the application.

It appears from the submissions of the learned Counsel that earlier, permission was given to the applicant/accused to travel abroad, however, he did not avail it. However, now, the applicant's daughter Is graduating in U.K. between 15.7.2019 and 17.7.2019 and hence, he has preferred this application. In view of the submissions, the application is allowed on the following terms:

i) The applicant/accused is allowed to travel to U.K. from 11.7.2019 to 21.7.2019;

ii) The Investigating Officer of Bundgarden police station, Pune, is directed to hand over the passport of the applicant/accused in relation to C.R. No.130 of 2017 on production of an authenticated copy of this order;

iii) The applicant/accused is directed to furnish a cash surety of Rs.1 lakh in the trial Court;

¶21

iv) The applicant/accused is directed to submit his itinerary details alongwith his residence and contact details at the U.K. to the Investigating Officer.

v) The applicant/accused is directed to return his passport to the Investigating Officer after his return from U.K. on or before 26.7.2019.
