1 By this appeal, the appellant/accused is challenging the Judgment and Order dated 05/05/2017 passed by the learned Special Judge, under Protection of Children from Sexual Offences Act, 2012 (Hereinafter referred to as 'the POCSO Act' for the sake of brevity), Pune in Special POCSO Case No.439 of 2015 thereby

convicting him of the offences punishable under Sections 6 and 8 the POCSO Act. For the offence punishable under Section 6 of the POCSO Act, the appellant/accused is sentenced to suffer rigorous imprisonment for ten years apart from direction to pay fine of Rs.3,000/- and in default to undergo rigorous imprisonment for one year. Though, the appellant/accused was also convicted for the offence punishable under Section 8 of the POCSO Act, no separate sentence came to be imposed on him by holding that the offence punishable under Section 8 of the POCSO Act is a minor offence than the offence punishable under Section 6 of the POCSO Act.

2 Facts in brief leading to the prosecution and resultant conviction of the appellant/accused can be summarized thus :

(a) The victim of the alleged crime in question was below 12 years of age at the time of commission of the alleged offence. He was taking education in 5^th Standard in Semi-English school named Maharashtra Vidyalaya at Pune. He was residing in the Hostel of the school named Vidyarthi Vasatigruh located at Sadashiv Peth, Pune. The appellant/accused was serving in the said Educational Institute as Rector of the Hostel. According to the prosecution case, on 31/08/2015 in the morning hours, the appellant/accused called the victim child/P.W.No.2 at

his room and made him to lie in the prone position. He then slept on person of the victim child/P.W.No.2. After doing some obscene act with the victim child/P.W.No.2, the appellant/accused then made the victim child/P.W.No.2 to suck his nipples. Thereafter, on 01/09/2015, the appellant/accused again called the victim child/P.W.No.2 in his room in the Hostel and repeated the same act. On 02/09/2015, the victim child/ P.W.No.2 was called in his room by the appellant/accused. He was made to lie in the prone position after removing the clothes. The appellant/accused then removed his underwear and slept on person of the victim child/P.W.No.2. He then inserted his penis in the anus of the the victim child/P.W.No.2. Then, the victim child/P.W.No.2 was threatened and directed not to disclose the incident to anybody. On 03/09/2015 also the appellant/accused called the victim child/P.W.No.2 to his room and committed penetrative sexual assault on him. The victim child/P.W.No.2 was again threatened by the appellant/accused.

(b) After the incident of penetrative sexual assault, the victim child/P.W.No.2 felt giddiness and had suffered a fall on 05/09/2015. He was taken to the hospital.

(c) At about 9.30 p.m. of 05/9/2015, the victim child/P.W.No.2 as usual had given a missed call on mobile phone of his father P.W.No.1 Sudam. Then, P.W.No.1 Sudam called back. The victim child/P.W.No.2 then told his father to come to Pune for meeting him. On 06/09/2015, P.W.No.1 Sudam went to Vidyarthi Vasatigruh, Pune and met the victim child/P.W.No.2. When he came to know that his son became unconscious on a day earlier, after getting necessary permission from the appellant/accused, he was taken to his house at village Mandavgan Farata, Taluka Shirur, District Pune by his father P.W.No.1 Sudam. There the victim child/P.W.No.2 was treated by Dr.Shinde-Patil as well as Dr.Shriniwas from Daund. On 13/09/2015, P.W.No.1 Sudam told his son - the victim child/P.W.No.2 that the victim child/P.W.No.2 will be reached to the Hostel at Pune. Then, the victim child/P.W.No.2 disclosed the incident of sexual assault as well as penetrative sexual assault on him by the appellant/accused, who was working as a Rector of the Hostel. P.W.No.1 Sudam then disclosed the incident to his cousin and then the FIR (Exhibit 8) came to be lodged with Police Station, Vishrambag, Pune leading to the registration of Crime No.284 of 2015 against the appellant/accused.

(d) The victim child/P.W.No.2 was then sent to the Sasoon Hospital, Pune for medical examination. He was examined by PW..No.4 Dr.Smita Kakade, Senior Resident as well as P.W.No.5 Dr.Harish Tatia, Assistant Professor. The spot was inspected and on completion of routine investigation, the appellant/accused came to be charge-sheeted.

(e) The learned Special Judge framed and explained the charge for the offences punishable under Sections 6 and 8 of the POCSO Act to the appellant/accused. He pleaded not guilty and claimed trial.

(f) In Order to bring home the guilt to the appellant/accused, the prosecution has examined in all six witnesses. Father of the victim child is examined as the P.W.No.1. The victim child is examined as the P.W.No.2. Prashant Kharwalikar, a panch witness to the spot panchanama is examined as the P.W.No.3. Exhibit 17 is the spot panchanama. Exhibit 18 is the seizure panchanama of the clothes of the victim child/P.W.No.2. Dr.Smita Kakade, Senior Resident is examined as the P.W.No.4. Exhibit 22 is the Medico Legal Certificate issued by her. Dr.Harish Tatia, Assistant Professor is examined as the P.W.No.5. Exhibit 23 is the documents of

medical examination of the victim child/P.W.No.2 by P.W.No.5 Dr.Harish Tatia, Assistant Professor. Investigating Officer Vaishali Adkur, PSI is examined as the P.W.No.6. Exhibit 35 is the Birth Certificate of the victim child/P.W.No.2 issued by the Registrar under the Registration of Births and Deaths Act, 1969.

(g) Defence of the appellant/accused was that of total denial. According to the defence happening of the alleged incident is improbable in the wake of presence of staff members as well as several pupils in the school as well Hostel.

(h) After hearing the parties, the learned trial Court was pleased to convict and sentence the appellant/accused as indicated in the opening paragraph of this Judgment.

3 I heard Ms.Jain, the learned Counsel appointed to represent the appellant/accused at the cost of the State at sufficient length of time. She vehemently argued that the incident in question as disclosed by the victim child/P.W.No.2 is improbable in the wake of the situation prevalent on the spot of the incident brought on record from cross-examination of P.W.No.3 Kharwalikar. Besides the room of the victim child/P.W.No.2, there were offices of Krishnaji Kulkarni as well as Ramesh Kulkarni and

Joshi Sir. The school and Hostel was having 100 to 120 staff members. The school used to start from morning. She, therefore, argued that room of the appellant/accused was at the ground floor whereas the Hostel was situated on the first floor. Several students used to reside in the said Hostel and, as such, it was not possible to commit such offence.

4 The learned Counsel further argued that crossexamination of the victim child/P.W.No.2 shows that teacher named Bahirath had visited the victim child/P.W.No.2 when he was taken to the hospital on 05/09/2015. However, said Bahirath is not examined by the prosecution. It is further argued that the victim child/P.W.No.2 has failed to disclose the incident immediately to his father. The incident in coming on record through his evidence by way of omission and, therefore, the appellant/accused deserves acquittal.

5 The learned Additional Public Prosecutor supported the impugned Judgment and Order of conviction and resultant sentence by contending that evidence of the victim child/P.W.No.2 is gaining corroboration from the medical evidence adduced by the prosecution.

6 I have considered the submissions so advanced and also perused the Record and Proceedings including the oral as well as documentary evidence adduced by the prosecution.

7 By now, it is well settled that in sexual offence, the Court carries great responsibility and such type of cases are required to be decided by taking into consideration the broader probabilities of the prosecution case and ignoring minor inconsistencies and discrepancies. Charge against the appellant/accused was for the offences punishable under Sections 6 and 8 of the POCSO Act and, as such, it was incumbent on the part of the prosecution to establish a fact that the the victim child/ P.W.No.2 was a child as defined by Section 2(d) of the POCSO Act. Evidence of the victim child/P.W.No.2, to the effect that he is 11 years of age when he entered in the witness box is not even challenged in the cross-examination. Father of the victim child namely P.W.No.1 Sudam had deposed that the victim child/P.W.No.2 was born on 19/12/2004. He had further deposed that report of birth of the victim child/P.W.No.2 was made to the Grampanchayat office of village Mandavgan Farata, Taluka Shirur, District Pune on 30/12/2014 and it was recorded at Registration No.243. This evidence is also not shattered in the crossexamination of the father of the victim child. The prosecution has placed on record Certificate issued by the Registrar under the Registration of Births and Deaths Act, 1969 i.e. Village Development Officer Grampanchayat Mandavgan Farata, Taluka Shirur, District Pune. The said Certificate is at Exhibit 35. The same is issued under the provisions of Sections 12 and 17 of the Registration of Births and Death Act, 1969 and, as such, it is

directly admissible in evidence in view of Section 77 of the Indian Evidence Act. This Birth Certificate of the victim child/P.W.No.2 shows that he was born on 19/12/2014. With this evidence, the prosecution is successful in establishing the fact that on the dates of alleged incident the victim boy/P.W.No.2 was below 12 years of age. The incident in question allegedly took place on 31^st August 2015 as well as 2^nd and 3^rd September 2015. The victim child/P.W.No.2 is a child witness. Evidence of child witness is required to be scrutinized carefully as well as cautiously for the reasons that children are prone to tutoring. The Court is required to seek corroboration to the evidence of child witness and such evidence can be accepted if it withstand the close scrutiny by careful circumspection. In the light of this position of law, let us consider what the victim of the crime in question has deposed about the incident. Prior to that it needs to be put on record that the undoubtedly the appellant/accused was working as Rector at the Vidyarthi Vasatigruh, Sadashiv Peth, Pune where the victim child/P.W.No.2 was residing for taking education. This position is clear from cross-examination of P.W.No.3 Prashant Kharwalikar.

8 On this backdrop, it is in evidence of the victim child/P.W.No.2 that the appellant/accused had called him in his room. He then removed his shirt and pressed the mouth of the victim child/P.W.No.2 on his chest. The victim child/P.W.No.2 further deposed that on 2^nd and 3^rd day also he was called at the

room of the appellant/accused. On these occasions, as per version of the victim child/P.W.No.2, the appellant/accused removed the pant of the victim child/P.W.No.2 and he was made to sleep on the bed. The victim child/P.W.No.2 further deposed that then the appellant/accused also removed his pant. Thereafter, the appellant/accused slept on person of the victim child/P.W.No.2 and started giving jerks. The victim child/P.W.No.2 further deposed that thereafter the appellant/accused inserted something in his anus. This, according to the victim child/P.W.No.2, took place prior to 5^th September 2015 and he disclosed the incident to his Hostel-mate Shubham.

9 To caste doubt on version of the victim child/P.W.No.2, it is elicited from his cross-examination that his school hours were 12.00 noon to 5.00 p.m. and in his hostel room apart from him 10 to 12 students were staying. So far as the spot of the incident is concerned, it is brought on record from evidence of the victim child/P.W.No.2 that room of the appellant/accused was visible from the staircase and the room where the victim child/P.W.No.2 was staying was situated at the first floor of the building. It is further brought on record from his cross-examination that students taking education in 5^th to 8^th Standard were not permitted to have cellphones and he was using cellphone of boy student in 12^th Standard to give missed call to his father. The victim child/P.W.No.2 accepted the fact that when he suffered giddiness, another teacher by name Bahirath came to the hospital.

10 For shattering the version of the victim child/P.W.No.2 and to introduce element of the improbabilities in the prosecution case, the defence has cross-examined the spot panch P.W.No.3 Prashant Kharwalikar at length. From his cross-examination, it is brought on record that besides the room of the appellant/accused, offices of Krishnaji Kulkarni, Ramesh Kulkarni and Joshi Sir are located. Office work starts 7.00 a.m. of the day and about 100 to 125 staff members works at that place. The school also starts from the morning. Similarly, it is also brought on record from crossexamination of this panch witness that the appellant/accused used to stay in the school premises at night hours. This panch witness has vouched about the situation prevalent on the spot of the incident reflected in spot panchanama (Exhibit 17). As per version of this witness, corroborated by the contemporaneous documents, room of the appellant/accused where he used to reside in the school-cum-hostel premises was admeasuring 10 x 6 feet. It was having a cup-board where his clothes were kept. That room was also containing a cot.

11 It is a matter of common knowledge that sexual offences are committed stealthily and in isolation. Evidence of the victim child/P.W.No.2 makes it clear that the appellant/accused used to call him in his room in the morning hours and there he was subjected to sexual assault by the appellant/accused. This version of the victim child/P.W.No.2 is gaining corroboration from

the situation prevalent on the spot of the incident reflecting from the spot panchanama (Exhibit 17) which shows existence of cot and bed in the room where the appellant/accused used to reside. Other staff members and students are not expected to know what is happening inside the four walls of the room of the appellant/accused, who was working as Rector in the Hostel of the school where the victim child/P.W.No.2 was taking education. Hence, it is not possible to hold that the prosecution story is improbable and no such incident could have taken place in presence of pupils and staff members working in the school and the Hostel.

12 Now, let us examine what offence is held to be proved against the appellant/accused. On this aspect, the victim child/P.W.No.2 has deposed that apart from pressing his mouth on bare chest of the appellant/accused, the appellant/accused on other occasions had removed his pant and made him to lie on the cot. Thereafter, the appellant/accused after removing his pant slept on his person and gave jerks. Then, as per version of the victim child/P.W.No.2, the appellant/accused inserted something in his anus. As per Section 3 of the POCSO Act, inserting to any extent any object or a part of body not being the penis in the anus of a child makes the offence of penetrative sexual assault. Similarly, insertion of penis to any extent in the anus of a child also constitutes the offence of penetrative sexual assault. As noted

in the foregoing paragraph, child witness is prone and susceptible to the tutoring and in such process they are in the habit of exaggerating the things. In the case in hand, cross-examination of the victim child/P.W.No.2 shows that his evidence to the effect that the appellant/accused inserted something in his anus is coming on record by way of omission. The child witness had omitted to state this part of the alleged act of the appellant/accused either to the Investigator while recording his statement under Section 161 of the Code of Criminal Procedure or to the Judicial Magistrate First Class while recording his statement under Section 164 of the Code of Criminal Procedure. The improvement so surfacing on record from evidence of the victim child/P.W.No.2 is material and is going to the root of the matter. If the appellant/accused had really inserted something in the anus of the victim child/P.W.No.2 what prevented him from disclosing this fact either to the Investigator or to the learned Judicial Magistrate First Class is not explained by the prosecution in its evidence. As this omission is in respect of vital part of the prosecution case, evidence of the victim child/P.W.No.2 needs to be read by ignoring this improvement in material particular.

13 Evidence of the Medical Officer is certainly a corroborative evidence and for using the same, substantive evidence must be on the record. P.W.No.5 Dr.Harish Tatia, Assistant Professor had clinically examined the victim

child/P.W.No.2 on 16/09/2015. Similarly, PW..No.4 Dr.Smita Kakade, Senior Resident had also examined the victim child/P.W.No.2. No external injuries were found on the person of the victim child/P.W.No.2 by both these Medical Officers. However, P.W.No.5 Dr.Harish Tatia, Assistant Professor on conducting lateral traction test of buttock of the victim child/P.W.No.2 found that there was reflex dilatation of anal opening of the victim child/P.W.No.2. This finding is also reflected in the contemporaneous medical record at Exhibit 23. This finding could have been used for corroborating the version of the victim child/P.W.No.2 if he had spoken about the penetrative sexual assault at the first available opportunity to the Investigator as well as to the learned Judicial Magistrate First Class during recording of his statement under Section 164 of the Code of Criminal Procedure. The said statement was recorded on 23/10/2015 i.e. much later after recording of the FIR on 14/09/2015. But the victim child/P.W.No.2 had omitted to state about the penetrative sexual assault on him to the learned Judicial Magistrate First Class. As such, corroborative evidence coming from mouth of P.W.No.5 Dr.Harish Tatia, Assistant Professor is of no avail to the prosecution.

14 So far as evidence of P.W.No.1 Sudam is concerned, the same is corroborating the version of the victim child/P.W.No.2 so far as the incident of sexual assault is concerned. His evidence

makes it clear as to how the victim child/P.W.No.2 managed to escape from custody of the appellant/accused by calling his father. After the incident of sexual assault on him, as disclosed by the victim child/P.W.No.2 as well as his father P.W.No.1 Sudam, the victim child/P.W.No.2 suffered from giddiness and was taken to the hospital and on the very same day, he spoke with his father telephonically. He called P.W.No.1 Sudam to Pune and went back to his house. The victim child/P.W.No.2 showed his reluctance to come back to the Hostel on 13/09/2015 and then disclosed the happenings to his father P.W.No.1 Sudam. As seen from evidence of P.W.No.1 Sudam, this has resulted in lodging the FIR (Exhibit 8) by P.W.No.1 Sudam. Thus, version of P.W.No.1 Sudam is corroborating the evidence of the victim child/P.W.No.2, so far as incident of sexual assault is concerned.

15 The victim child/P.W.No.2 was barely 11 years of age and was admitted to the Hostel in June 2015. The incident of sexual assault on him took place in the end of August 2015 and beginning of September 2015. Considering the teen age of the victim child/P.W.No.2, non-disclosure of the incident by him while in the Hostel and in the hospital far away from his parents to another teachers of Maharashtra Vidyalaya, Pune where he was taking education, cannot be given any overbearing importance for doubting version of the victim child/P.W.No.2. On the contrary, the situation in which the victim child/P.W.No.2 was suffering from trauma made him introvert not to disclose the incident to the staff

members of the Educational institute and the Hostel. This seems to be a normal conduct of the victim child/P.W.No.2 aged less than 11 years.

16 In the result, I hold that the prosecution has established that the appellant/accused called the victim child/P.W.No.2 in his room and by removing his pant and also by removing his own pant had slept on person of the victim child/P.W.No.2 apart from pressing the mouth of the victim child/P.W.No.2 on his bare chest. However, so far as the incident of penetrative sexual assault is concerned, the appellant/accused is certainly entitled for benefit of doubt in view of omission surfacing from evidence of the victim child/P.W.No.2 in that regard. Sleeping on bare body of the victim child/P.W.No.2 reflects sexual intent on the part of the appellant/accused. Evidence on record certainly shows that the appellant/accused was involved in physical contact with the victim child/P.W.No.2 with sexual intent making it the offence punishable under Section 8 of the POCSO Act which ultimately turned into the offence of aggravated sexual assault as the victim child/P.W.No.2 was below 12 years of age and the offence was committed by the staff member of the Educational Institution where the victim was studying and residing. The same is made punishable under Section 10 of the POCSO Act. The offence held to be proved is lesser offence than offence for which the appellant/accused is convicted by the learned trial Court.

Moreover, the charge for the offence punishable under Section 8 of the POCSO Act was also framed and explained to the appellant/accused and as such, he was certainly aware to the charge of sexual assault levelled against him. Therefore, the appellant/accused is liable for conviction and resultant sentence for the offence punishable under Section 10 of the POCSO Act. In the result, the following Order :

(i) The Appeal is partly allowed in following terms.

(a) Conviction of the appellant/convicted accused for the offence punishable under Sections 6 of the Protection of Children from Sexual Offences act, 2012 and resultant sentence imposed on him for the said offence is quashed and set aside.

(b) Instead, the appellant/accused is convicted of the offence punishable under Section 10 of the POCSO Act and he is sentenced to suffer rigorous imprisonment for five years apart from direction to pay fine of Rs.3,000/- and in default to undergo further rigorous imprisonment for one year.

(ii) The Appeal stands disposed of accordingly.
