Angad Rambhau Jadhavar Vs the State of Maharashtra and Ors.

The above Petition has been filed for registering an FIR against the officers of the Maharashtra State Electricity Distribution Company Ltd. ('MSEDCL'). The allegation in the complaint which has been addressed by the Petitioner to various police authorities is in respect of installation of electricity poles in the agricultural land of the Petitioner which, according to the Petitioner, is without the permission of the Petitioner and hence according to the Petitioner, the offences under Section 442 and 447 of the IPC have been committed by the officers of the MSEDCL.

Without going into the aspect as to whether the MSEDCL is entitled to lay the poles having regard to the powers which have been conferred on the electricity distribution licensee, we are of the view that it would be better if the Petitioner invokes the writ jurisdiction of this Court on the Civil Side to seek appropriate reliefs for use of his land, including compensation, if entitled in law. We, therefore, do not deem this a fit case to issue the directions which the Petitioner has sought by way of the above Writ Petition. The Writ Petition is accordingly disposed of.
