Learned Counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to approach the Apex Grievance Redressal Committee [erstwhile the High Power Committee] constituted under section 35(1A)(b) of the Maharashtra Slum Areas (Improvement, Clearance & Redevelopment) Act, 1971 to redress his grievance raised in the writ petition. Leave with liberty as prayed for is granted. Writ petition is allowed to be withdrawn and is dismissed as such.

It is clarified that this Court has not gone into merits of the matter and all points and contentions of the respective parties are kept open. In the event Petitioner approaches the HPC, his application shall be decided independently, on its own merits and in accordance with law.
