decided to resolve the issue. The discussions as need in the joint meeting were recorded in an E-mail dated 30 July 2015. The contents of the said E-mail are also not disputed by the appellant/defendant. Further, post dated cheques were forwarded by the appellant/defendant, however, on an assurance that after the payment is made, the cheques would be returned. Further an amount of Rs.5,00,000/- was forwarded by the appellant/defendant with an assurance that the principal amount would be released by 31 May 2016. However, this assurance fetched no results. The respondent/plaintiff sent repeated reminders demanding payment. By a letter dated 7 June 2016 the respondent/plaintiff demanded the entire amount due and payable alongwith the interest. A statement of interest calculation was also prepared and forwarded to the appellant/defendant. As nothing was heard from the appellant/defendant, the respondent/plaintiff addressed a legal notice dated 1 February 2017 and called upon the appellant/defendant to release payment of Rs.1,20,77,267/- alongwith the interest of Rs.65,42,838/-, totaling to an amount of Rs.1,86,20,105/-. As the notice was not complied, the respondent/plaintiff filed this summary suit and has taken out the summons for judgment.
