By this Civil Application, the applicant/insurance company seeks stay to the execution and implementation of the impugned judgment and award dated 14.12.2016 passed by the learned Member, Motor Accident Claims Tribunal, Thane in M.A.C.P. No. 814 of 2014.

The learned Counsel for the applicant submits that the original claimants have moved an application before the tribunal for withdrawal of the amount of compensation. By order dated 22.01.2018, the learned Member of the tribunal has allowed the application for withdrawal of the amount. She further submits that in fact the original claimants have withdrawn the entire amount of compensation and, therefore, she prays that the order dated 22.01.2018 passed by the learned Member of the tribunal be recalled.

The order dated 22.01.2018 passed by the tribunal is in fact executed fully. It appears that the insurance company has not filed Appeal within the stipulated time and hence, decree is executed. Under such circumstances, the application for stay cannot be entertained, as it is executed.
