the applicant had not approached the Sessions Court after filing of the charge-sheet. The application which was rejected on 23rd February 2018 is prior to filing of the charge-sheet, whereas now the chargesheet is filed. In view of this, learned counsel for the applicant,upon instructions seeks liberty to approach the Sessions Court under Section 439 of Cr.PC. in

the changed circumstances. Liberty as prayed for is granted in the interest of justice.
