The application is filed for bail in C.R. No.262 of 2015 registered with Bhosari Police Station, Pune, for the offence punishable under Section 395 of Indian Penal Code, etc. Both the sides are heard. Papers of investigation were made available.

The crime is registered on the basis of the report given by one Parshuram Gaikwad. He is working as cashier at Sai Gauri Gas Pump, Kundannagar. The incident in question took place on 30.08.2014 at about 9:30 pm. when he and his three colleagues were discharging their duties. On two motorcycles six persons came there with weapons like Chopper and Wooden logs. They gave beating to him, snatched the cash amount which was with him by giving threats. The cash amount of Rs.14,360/- was taken away.

During the course of investigation five persons were arrested and present applicant was shown as absconding for some time. He surrendered before the police on 12.10.2016. The material shows that TI parade was not held.

A query was made and the learned APP was asked as to

whether the appellant has bad antecedent. There is no such record. As he himself surrendered this court holds that it is not desirable to keep him behind the bar till the disposal of the case. It is not certain as to how much time will be required for the disposal of the case. Hence the application is allowed. The applicant is to be released on bail on furnishing PB of Rs.50,000/- with one or more solvent sureties of like amount. He is not to tamper with the prosecution witnesses. He is not to commit similar offence.
