1] The applicants are facing prosecution for offence punishable under Section 420 of the Indian Penal Code on a complaint filed by the respondent No.2, pending on the file of Metropolitan Magistrate, 23^rd Court at Explande Mumbai.

2] Learned Counsel appearing for the applicants submitted that the parties herein have settled the matter amicably out of Court and the applicants have paid the money involved in the said complaint to the respondent No.2 herein. The said consent terms are taken on record and marked “X” for identification. The said consent terms are duly signed by the parties and their signatures have been identified by their respective Advocates.

3] In view of the said consent terms, the Order dated 26^th May 2011 of issuance of process is hereby quashed and set aside and Criminal Complaint bearing No.180/SW/11 pending before the Metropolitan Magistrate, 23^rd Court at Esplanade Mumbai is also hereby quashed.

4] Application is disposed off in the aforesaid terms.

5] All the concerned to act on an authenticated copy of this Order.
