arrested in C.R. No. 13/2006 of Shirala Police Station, Sangli.
The said case was numbered as Sessions Case No. 36 of 2006. In the said case, by judgment and order dated

31.1.2008 passed by the learned Sessions Judge, Sangli, the petitioner was convicted under Section 307 of IPC and sentenced to life imprisonment. Being aggrieved thereby, the petitioner preferred Criminal Appeal No. 272 of 2008 before this Court. This Court, by Judgment & Order dated 10.10.2013, partly allowed the appeal. The conviction under Section 307 was maintained, however, the sentence of life imprisonment was reduced to the period undergone by the petitioner i.e 7 years and 4 months. When the appeal was disposed of by this Court, it was not brought to the notice of this Court that the petitioner was not through out in jail but in fact, he was on bail pending the trial from 27.6.2006 till 31.1.2008. The prayer of the petitioner in the present petition is that the period of imprisonment imposed by this Court i.e of 7 years and 4 Months be reduced to the period undergone by the petitioner.

in Criminal Appeal No. 272 of 2008, however, the learned APP, on instructions, states that the petitioner has completed
the sentence of imprisonment and was released from prison.
In this view of the matter, this petition is infructuous, hence,
rule is discharged.
