After arguing for some time, learned counsel for the petitioner seeks leave to withdraw this petition with libetry to file an application under Order 39 rule 2A of the Code of Civil Procedure and/or any other application/suit before the trial Court for redressal of the grievance raised in this petition. He however, makes a limited prayer that in case application under Order 39 rule 2A is filed by the petitioner, the Court seized over the matter be directed to expediate disposal of such application.

Having considered the submissions made by the learned counsel for the parties and the prayer made by the petitioner, we are inclined to allow the petitioner to withdraw this petition with a liberty to file appropriate application/suit for redressal of his grievance raised in this petition. In case the petitioner files an application under Order 39 Rule 2A, the trial Court is expected to decide the same as expeditiously as possible.
