The Applicant was called upon to show cause within a period of two days. The response of the Applicant was in the form of a letter dated 8th October, 2015. Though the Applicant denied that the ground is used for commercial purposes, the Applicant was frank enough to declare that it was proposing to erect stalls and give the stalls to vendors, who may in turn cater to the needs of the devotees. Thus, in the reply itself they admitted that the stalls erected will be given to vendors. It is not the case made out in the reply that the vendors were to do charity work and take care of the devotees free of cost. In first part of paragraph 2 of the reply, it is stated that this year onwards no cooking of raw materials like fish, meat, chicken would be allowed at the stalls. All food being distributed at the food stalls will be pre-cooked and only heated at the site. Further, the Applicant specifically stated that the only cooking that will be done on the ground will be of Bhog (Prasad) which is purely a vegetarian food. On a query made by the learned counsel appearing for the Applicant, it is stated that this food was cooked on the ground to cater 8,000 to 10,000 people. Paragraph 3
