On 8th April, 1996, the respondent issued charge-sheet to the petitioner on the ground of misconduct of unauthorized absentism from duty. During the pendency of the inquiry the petitioner sought adjournments on the medical ground, however, the Inquiry Officer proceeded ex-parte against the petitioner and concluded the inquiry as ex-parte. The report was submitted by the Inquiry Officer on 14th February, 1997 stating that the misconduct of the petitioner stands proved. A show cause notice was issued on 15th March, 1997 by the respondent alongwith the copy of the inquiry report to the petitioner, to submit his reply. The petitioner submitted his detailed reply. The respondent terminated the services of the petitioner on 24th June, 1997 on the ground that the misconduct is proved. The petitioner raised an Industrial dispute before the Industrial Court, Kolhapur. The petitioner approached to the Conciliation Authority, Pune. The Additional Commissioner of Labour Court, Pune Division, Pune, referred the matter to the learned Labour Court, Solapur, for adjudication. The learned Presiding Officer of Labour Court, Solapur, Camping at Kolhapur dismissed the reference. He however directed that it would be open for the respondent to appoint petitioner in its employment as a fresh clerk on the basis of his undertaking, not to repeat the misconduct again. Against the said order of the Labour Court, the petitioner preferred the writ petition bearing No.7471 of 2006 before the learned Single Judge of this Court. The learned Single Judge dismissed the petition filed by the petitioner. Being aggrieved by the order passed by the learned Single Judge, the petitioner has filed the
