1.The Petition pertains to a female minor Jolene, born on 23rd
April 2006. She was proposed in guardianship to the present
Petitioners, Mr. Joseph Fernandes and Mrs. Ginnette Fernandes by
Guardianship Petition No. 10 of 2010. This was granted on 17th
February 2010.

2.This Adoption Petition comes to be filed now in view of the
decision of the Hon’ble Mr. Justice F.I. Rebello in In Re: Manuel
Theodore D’Souza.1
3.The Petitioners reside in Santacruz. They are aged about 60
and 47 years old respectively, and have been married for 18 years
with no children of their own. They are in good health. The 1st
Petitioner is self-employed and is the Managing Director of his own
Company in Matunga. His wife, the 2nd Petitioner, works as an
Executive Assistant with SKF India Limited with a monthly salary
of over Rs.85,000/-. The financial documents of the Petitioners are
in order. The Petitioners have deposited a sum of Rs.1,01,800/- in
the name of the child with the LIC Komal Jeevan Plan. The
certificate is on file. I have seen the adoption home study report and
follow up visit report. This is overall positive. The minor’s health is
normal. Her immunizations have been attended to. She has a close
relationship with her adoptive parents and is well settled at St.
Joseph’s Convent School in Bandra, where she is presently in the
5th standard. She also takes piano lessons.
4.In view of the statements made and Mr. Hareendran’s
Scrutiny Report dated 15th October 2016, which is taken on record
and marked “X” for identification, the Petition is allowed and the
Judge’s Order is separately signed.
