The learned Counsel for the Applicant informs the Court that the notice that the Appeal would be taken up today on the Production Board, is already served on the Respondents No. 1 & 2 (Original Plaintiffs.) The learned Counsel undertakes to file Affidavit of Service to that effect. For the reasons which are recorded in the order dated 13th December 2016, it appears that the Respondents No. 1 and 2 are not interested to appear in this Appeal, as the Applicant Mr.Anil Wadhare, has purchased the suit property. Accordingly, Civil Application No. 4840 of 2016 as filed on behalf of the Applicant (Mr.Anil Whadare) to implead the Applicant as a party Respondent to this Appeal is required to be allowed. The Civil Application is accordingly allowed in terms of prayer clause (a). Amendment be carried out on or before 23 December 2016. No costs.
