1. Heard learned counsel for the appellant.

2. This is an application seeking permission to
withdraw the appeal presented by the appellant-The
Commissioner of Central Excise and Customs, Aurangabad,
in view of the policy recently formulated by the
Department.

3. Considering the facts sated in the application,
the application deserves to be allowed and the same is
accordingly allowed and disposed of.

¶17

4. The First Appeal is permitted to be withdrawn
and disposed of as such. There shall be no order as to
costs. Pending civil applications stand disposed.
