PW 3 Hari who was residing next to the applicant has stated that quarrel had taken place between the applicant and injured Mahavir on account of Khushboo, the wife of the applicant. The incident occurred in the night between 31.12.2010 and 01.01.2011. PW 4 Mahavir who was sleeping in the same room as the applicant and his wife Khushboo has stated that when he was sleeping, the applicant inflicted blow with spade on his forehead, hence, he woke up. After he woke up, again, the applicant inflicted another blow over his left eyebrow due to which he became unconscious. The evidence on record shows that in the same room, Khushboo was found lying dead with injuries on
her head. No one else was residing in the hut except the
applicant, Mahavir and Khushboo.
