ORDER:

1 Heard the learned Counsel appearing for the Appellant. By the impugned order, the learned Company Judge has made a Company Petition filed by the Respondent for winding up of the Appellant absolute.

2 The submission of the learned Counsel appearing for the Appellant is that the impugned order has been passed only on the ground that the Appellant could not file a Reply. He relied upon Memorandum Understanding dated 23 March 2011 under which the possession of a plot held by the Company has been handed over to M/s. Bran Engineering Private Ltd. He submitted that the said document was suppressed.
