Learned APP pointed out that the petitioner was convicted mainly under Section 302 of IPC in Sessions Case No. 20 of 2009 by the learned Sessions Court, Nashik. Being

aggrieved thereby, the petitioner preferred Criminal Appeal No. 173 of 2010 before this Court. This Court by Judgment & Order dated 10.9.2014 acquitted the petitioner of all the offences. Pursuant to the judgment and order of this Court, the petitioner has been released from prison on 16.9.2014. In this view of the matter, the prayer of the petitioner becomes infructuous. Hence, Rule is discharged.
