1 Heard the learned counsel Mrs. Nasreen S.K. Ayubi for the petitioner and Mr. Dedhia, the learned A.P.P. for the State.
2 Rule. By consent, rule is made returnable forthwith and the petition is taken up for final hearing.
3 The petitioner was granted parole on 23.2.2013. He sought extension for parole which came to be rejected. Being aggrieved thereby, the petitioner has preferred this petition.

Superintendent of Nashik Road Central Prison, Nashik. The said report is taken on record and marked `X' for identification. The report shows that the petitioner has been acquitted in the criminal appeal preferred by him i.e. Appeal No. 1268 of 2007 by judgment and order dated 23.10.2013 and pursuant to the said judgment and order, the petitioner has been released from prison. In this view of the matter, this petition is infructous and is disposed of accordingly. Rule is discharged.
