Litigations that the State of Maharashtra has issued directions after holding inquiry under section 13(1) and 14 of the Maharashtra Commission for Protection of Child Right Act, 2005. The Court expressed a view that since the age of children has been increased from 16 to 18 years under the provisions of Juvenile Justice (Care and Protection of Children) Act, 2000 and also Protection of Children from Sexual Offences Act, 2012, it is necessary to protect the children below 18 years and it may not be sufficient to issue a circular for the protection and prohibition of the use of children below the age of 12 years for performances popularly known as 'Dahi Handi'. It was therefore directed to the State Government to modify the circular and increase the age from 12 years to 18 years. The Division Bench also issued directions to the State Government to issue circular prescribing height of Dahi Handi, which shall not be more than 20 ft. Further directions were issued to the State Government to ensure that the organizers of Dahi Handi provide helmet, safety belts to Govindas at the beginning of the performances.
