The Company Application is for recall of a winding up order on the ground that all debts of the Company in liquidation have been discharged, since the passing of the winding up order. The Petitioning creditor, who appears before the Court, confirms that its debt has been discharged. The Assistant Official Liquidator confirms to the Court that besides the claim of the Petitioning creditor, there are no other claims against the Company in liquidation. Accordingly, the Company Application is allowed in terms of prayer clauses (a) and (b). The Official Liquidator is discharged. The Regional Director, Corporate Affairs and Registrar of Companies are directed to restore the name of the Respondent company on their website. The Applicant shall pay a sum of Rs.25,000/- to the Official Liquidator towards the costs, charges and expenses of the Official Liquidator. The Applicant shall also pay the Central Government commission on being communicated about the same by the Official Liquidator. Such payment shall be made within a period of two weeks from the date of the communication by the Official Liquidator. The Company Application is disposed of accordingly. There shall be no order as to costs.
