Heard the learned Advocates for the parties and by consent, the

following order is passed :

(i) All disputes between the parties arising out of the Agreement

dated 9^th April, 2012 are referred to the sole Arbitration of Mr. Akash Rebello, Advocate.

(ii) The learned Arbitrator shall endeavour to pass his Award within

a period of 8 weeks from the date of this order and if possible, hold

¶15

proceedings on day to day basis.

(iii) The parties and their Advocates shall meet the learned Arbitrator on 21^st August, 2015 at 5.00 p.m. at his Chambers and take necessary

directions in the matter.

(iv) Cost of the arbitration shall be borne by the parties equally.

¶22

(v) The Respondent who is present in Court, undertakes to hand

over possession of the Vehicle i.e. Maruti Swift Dzire bearing Registration No.MH-02/WA-7591, Engine No.D13A1760389 and Chassis No.MA3FSEB1S00437380 to Mr. Rahul Misra, Regional Manager, Panama Compound Andheri (E), Mumbai at 11.00 on 20^th August, 2015. The undertaking is accepted.

(vi) The Petitioner shall be at liberty to use the said vehicle. However, in the event of the Petitioner entering into any agreement of any nature whatsoever with a third party, the terms of such agreement shall not

exceed for a period of 8 weeks from the date of this order.

(vii)All contentions of the parties are kept open.

(viii) The above Arbitration Petition as well as Arbitration

Application are accordingly disposed of.
