2 The petitioner is the original accused. The respondent no.1 is the original complainant. The learned counsel for the petitioner states that the respondent no.1 has passed away. This has been confirmed by the learned counsel for the respondent no.1.
3 The learned counsel for the petitioner states that in view of the provisions of section 256 of the Code of Criminal procedure, he would seek the acquittal of the accused from the

trial court. The learned counsel for the respondent no.1, on the other hand, states that the heirs of the deceased complainant, would be brought on record and for that, an appropriate application shall be made before the trial court.
4 In this particular situation, permission is granted to the petitioner to withdraw the petition, with liberty to file another, for appropriate reliefs, should the need to do so arise.
5 Petition is allowed to be withdrawn, and stands dismissed as such, with liberty as aforesaid.
