The petitioner has challenged the order dated 31st December 2013 passed by the Chief Executive Officer, Satara. Learned counsel for the petitioner submits that against the said order, which is impugned in this petition, the petitioner has preferred appeal to the Divisional Commissioner, Pune on 21st January 2014. Along with the said appeal, the petitioner has filed stay application seeking interim relief. It is the grievance of the petitioner that in spite of appeal being filed, no orders are passed, so far.

In view of the fact that appeal has already been preferred to the Divisional Commissioner, we observe that the petitioner may prosecute proceedings of the appeal filed by him. In case petitioner desires to press stay application to seek interim relief, he may do so.

We direct the Divisional Commissioner to expeditiously deal with the stay application filed by the petitioner, in case the same is pending. With this observation and direction petition is disposed of.
