1] Rule. Rule made returnable forthwith.

2] The petitioner claims to have purchased the property at an auction

held under the provisions of the SARFAESI Act. An application was made to have the petitioner's name brought on the revenue record. Respondent No.2 – Superintendent Land Records is bound to decide the application.

3] Even if the respondent No.2 is of the opinion that the entries cannot

be made as requested by the petitioner, he must take a decision to that

effect and communicate the same to the petitioner. There is no point in leaving the issue undecided.

4] In the circumstances, the petition is disposed of by directing the respondent No.2 to take a decision on petitioner's application for making changes in the record of rights in respect of the property which is the subject matter of this petition.

There shall be no order as to costs.
