By this petition, the petitioner is

challenging the appointment order, whereby the

petitioner was directed to produce a caste validity certificate within a period of 90 days or else the services of the petitioner would be terminated. It is

submitted on behalf of the petitioner that the

petitioner is not at fault in not producing the caste validity certificate as the Scrutiny Committee has not decided the caste claim of the petitioner as yet.

Shri P.B. Patil and Shri K.P. Sadavarte, the learned Counsel for the respondents, state that if the caste claim of the petitioner is pending, the respondent no.3 Scrutiny Committee could be directed to decide the same within a time frame.

In view of the aforesaid, the writ petition is disposed of with a direction to the respondent no.3 – Scrutiny Committee to decide the caste claim of the petitioner within a period of one year. The interim relief granted by this Court would continue till the caste claim of the petitioner is decided. No costs.
