This petition challenges the order dated 12-2-2014 passed by the Divisional Commissioner, Amravati Division, Amravati, which was the subject-matter of challenge in earlier Writ Petition No.1205 of 2014, which was disposed of by this Court by passing an order as under :

“ In view of the objection taken by the learned counsel for the respondent No.4 about existence of alternate and efficacious remedy under Section 39(3) of the Bombay Village Panchayats Act, 1958, the learned counsel for the petitioner seeks permission to withdraw this petition with liberty to approach the State Government.

Permission is granted. The petition is disposed of as

withdrawn with liberty as prayed for. All questions are left open to be decided in such appeal.”

It is urged by Smt. Deshpande, the learned counsel appearing for the petitioner, that the appeal preferred before the State Government is pending. However, due to Code of Conduct of elections, no steps are being taken by the State Government.

I do not find any reason to interfere in the impugned order. The petition is dismissed.

¶16

The appeal pending before the State Government be decided within a period of three months from today.
